Labour Market Impact Assessment (LMIA)

A Labour Market Impact Assessment (LMIA) is a requisite process for a Canadian employer to hire a foreign worker in a Canada, unless the position and the foreign worker qualify for an LMIA-exempted work permit category. The Canadian government will use the LMIA process to determine how hiring the foreign worker in the Canadian position will impact the domestic labour market. An approved LMIA means there is no Canadian citizens or Permanent Residence who can fulfill that specific role at a particular time, and therefore there is a demand for that foreign worker to fill that job position. After an LMIA is approved, then the worker can apply for a work permit and start working in Canada. An approved LMIA can support either a temporary work permit or permanent residence in Canada.

LMIA Exemptions

Typically, a Labour Market Impact Assessment (LMIA) is required in order for a foreign national to be issued a work permit to work legally in Canada. However, there are some exemptions: Sections 204 to 208 of the Immigration and Refugee Protection Regulations (IRPR) allows for work permits to be issued to foreign workers without acquiring an LMIA, including intra-company transfers from or certain professional categories pursuant to certain international free trade agreements Canada holds with a number of countries around the world.

The LMIA-exemption categories can help you obtain a Canadian work permit without having to resort to the lengthy and highly rigorous Labour Market Impact Assessment.
